Oil Spill Update September 1, 2010

I hope this email finds you well and I wanted to bring you up to speed on a few changes to the BP claims process.
As you may have heard, on Monday, August 23rd, BP officially transitioned the claims process over to Ken Feinberg, who was appointed by President Obama to oversee the twenty-billion dollar escrow fund. This fund is called the Gulf Coast Claims Facility, or "GCCF."
According to Mr. Feinberg, everyone who filed with BP will unfortunately need to re-file with the GCCF, and you can do so in a number of ways:

Two very important things to consider:
First, if you are eligible and can prove your loss, you may file for an emergency payment from the GCCF for up to six months worth of a loss. According to their website, you will not be required to sign a waiver of any kind to receive this payment. You will need to consult your accounting and legal firms to determine what your projected emergency losses are. Keep in mind that after November 22, 2010 the emergency payment benefit will end.
From November 22nd forward, your claim will be considered a settlement for all future damages and you will be required to sign a release with BP waiving your right to sue. You will not be able to continue to file for losses by month as some of you have this summer. However, you may file your final settlement at anytime between now and the end of the GCCF funds' life cycle (said to be 3 years). I would recommend that you contact your accounting and legal firms to determine what your final claim and damages should be.
